Welcome to the forth issue of Consumer Protection’s bulletin for operators on the implementation of theRetirement Villages Amendment Act 2024and development of the Retirement Villages Regulations 2025.
Key industry stakeholders are currently reviewing draft Retirement Villages Regulations that will support changes to the Retirement Villages Act 1992 that were passed by Parliament in November 2024. Feedback on the draft Regulations will be provided to the Department of Local Government, Industry Regulation and Safety’s Consumer Protection division by close of business on Friday 30 January 2026.

Residents who have comments on the draft Regulations can provide feedback to Village Retirement WA, as the peak association representing residents’ interests.

The Retirement Villages Regulations will support the implementation of the Retirement Villages Amendment Act 2024 (Amendment Act) by providing the detail on:
· Improved disclosure requirements for operators including the availability of services and amenities, the tenure offered and costs.
· Requirements for operators to pay residents their exit entitlement or complete a buyback within 12 months of leaving the village.
· The entitlement of residents who have left the village to aged care to request the operator pay their exit entitlement to the aged care provider.
· Obligations and responsibilities around maintenance and replacement of capital items in the village.
· A resident’s responsibilities to reinstate or renovate premises after leaving the village.
· Rules of conduct for operators and residents, including requirements for operators to disclose and consult when prepare the annual budget for the village.
The Regulations and the operative provisions of the Amendment Act are expected to commence in 2026. Different parts of the Amendment Act may commence at different times. Further information on plans for commencement will be provided when the content of the Regulations has been settled.
Consumer Protection will publish guidance material and conduct a series of information sessions to assist the sector transition to the reforms.
